Sender: Hello GABOTAF! Tanong lang po. 3 to 4 months na na hindi natatanggap ng mother ko yong sahod nya from a national government agency.

Sabi daw po ng HR nila hindi pa pwede mareleased yong sahod nya kasi wala pa yong appointment order from the Civil Service Commission (CSC).

Tama po ba yong ginawa ng HR sa mother ko na i-hold yong salary nya especially ngayong pandemic na lahat nangangailangan.

Ano po ba CSC and COA ruling about dito? Pwede po ba i-reklamo ang HR sa CSC?

  1. Eto po ang steps na pwede nyo gawin:
    1. Make sure that that your mother has the necessary documents to back her appointment claims;
    2. Write a formal letter addressed to the Head of Office attention HRMO, stating your predicament and inquire the reasons for the delay in the payment of your mother’s salary, despite the issuance of her appointment and waiting for the attestation from the CSC. Kindly state 3rd paragraph of Section 17, Rule VI of ORAOHRA. Send it through courier para mas madali, then secure proof from courier that it was received;
    3. If in the remote event na hindi sumagot ang HR at Head of Office within 15 days from receipt, you may file a case against them pursuant to the pertinent provision of RA 6713;
    – if sumagot and unsatisfactory and walang basis ang reason, and lumalabas na whims lang or kapabayaan lang, you may file a complaint either for Gross Neglect of Duty against the HRMO and the Head of Office;
    – if gusto mo naman na “peaceful” lang ang life natin, kausapin na lang ang Head of Office na kung pwede ay ma sweldohan na ang Mommy mo, subject to a refund (which you can state in a Promissory Note), in the event that the appointment as issued in violation of pertinent CSC rules kn appointment.

  6. You are from NGA dapat na sahuran ka na, if not just call 8888, your agency cannot justify because frontloading of allotments are implemented. Then NGA are common fund policy is also implemented.

  7. Baka may kulang na requirements si employee… otherwise, pede na sya paswelduhin as long as “received” na ng CSC ang appointment nya. If in case madisapprove ng csc appointment nya… titigil lang sweldo nya from the time na mareceive nyo ang disapproval ng csc. No need to refund the salary previously paid. Hence, kung walang ibang reason bakit delayed ang sweldo, mali ang ginawa ng HR.

  9. pwede naman po hindi magreport si mother nyo. pero kung lumabas at maapprove po ang appointment mababawasan po yung matatanggap nya.

  10. Kung wala pa ang Appointment from CSC pero my copy na po ng Appointment signed by the Appointing Officer or Authority, and nakapag take-oath na and nkapag assumed ng duties and responsibilities of her position, pwd na po siya makasahod. Please refer to ORAOHRA Rule VI, Section 17 po.

  11. wala pa ung appointment fr. CSC peru pinapasok na sya, anung point nang HR?! kung may budget na doon para sayo pwd na un pasahod, unless hindi pa cgrado ang HR sa item na para sayo,.

  13. 1. Hindi nagrerelease ng appointment ang CSC (maliban nalang kung sa csc sya nagwwork). Ang csc po ay nagvavalidate ng appointment issued ng agency appointing authority.
    2. Maaaring iproseso ang sahod ng taong naappoint habang hinihintay ang validation ng appointment from csc (according to csc oraohra)
    3. Bago magreklamo, itanong munang mabuti sa HR kung bakit di pa napproseso ang initial salary.. baka may kulang na documentary requirements.

    Makipag-usap ng maayos sa hr para maliwanag ang lahat.. kasi for sure alam nila ang csc rules lalo na national agency yan.. baka may misunderstanding lang 🙂

  14. yan po yata bagong ruling ng CSC. ganyan din po sa aming agency. OHRA OHRA po yata yung bagong labas po.

  15. Khit wala attestation ng CSC pwedi bayaran ng salary ang employee.. kun na ARA na sya sa GSIS , na comply na Phic, Bir, hdmf, dtr. Accomplishment report , etc.. especially If fund is available..

  16. Pag new post kz need pa request sa dbm ang pondo. F my excess nca pwede bayaran na, but f wala just like in d case of ius schools, exact lng sa old positions.
