The procurement of second hand motor vehicle is not prohibited by Republic Act No. 9184 and its Implementing Rules and Regulations, Part A. What it prohibits is the procurement of second-hand vehicle through an auction.
As explained by the Government Procurement Policy Board — Technical Support Office (GPPB-TSO), purchasing a second hand motor vehicle from an auction is tantamount to direct contracting. Direct contracting may only be resorted to when the conditions prescribed under Sections 48 (b) and 50, of R.A. 9184 and its IRR-A, respectively, are present.
