Sender: Good pm po. May mga Job Orders po kami na matagal na po sa position at maasahan na sa mga trabaho ng isang section. Mas magagaling pa nga sila sa mga permanent employees.
May mga oras na kailangan talaga ang services nila. Are they allowed to render overtime services with corresponding pay? Can we know the legal basis? Thanks.

As a general rule, Job Order personnel are not entitled to Overtime Pay, with the following exceptions:
1. If it is explicitly stated in their contract;
2. For LGU: if there is an Executive Order from the Office of the Mayor/ Ordinance from Sanggunian;
3. Existence of national Government policy (national emergencies etc.) specifically allowing OT pay for J.Os
Note: for NGA’s po, the authority to render “OT with pay” issued by the Head of Agency for J.Os, without any DBM issuances authorizing the same may be defective and may be subject to COA questions later.

Yes if may Regional Order i cha.charge nmn din dun sa funds sa nag pa OT.. like if mg rendered ka ng OT sa OPCEN (HEMS Funds) pero ung sahud mo talaga ay sa (ORO) .allowed po un as long as may Regional Order indicating saan i charge ang funds.
