Good PM, GABOTAF. Another inquiry po about overtime. If yung employee nag logged in at 7:00 AM during a rest day, is the time between 7:00 to 8:00 AM included in the computation of overtime pay? Pwede po bang makahingi ng legal basis? Maraming salamat po sa sasagot.

  1. You are asking po the basis in computing a period. As a rule po, we exclude the first day/hour and include the last day/hour.
    The basis of this rule is the last paragraph of Article 13, Chapter 1 of R.A 386, otherwise known as the Civil Code of the Philippines, which provides that:
    “In computing a period, the first day shall be excluded, and the last day included. (7a)”
    Corrolarily, when we compute hours, for example from 7:00-11:00, we have to exclude the first hour of 7:00 – 8:00, and count the last hour of 10:00-11:00. Thus we will start counting from 8:00 up to 11:00 which would equal to four (4) hours.

  3. It depends on the requested hours for overtime. May internal policy dapat si office on this since ginrant ng flexibility ang heads of agencies ng dbm-csc via JC no. 2 s. 2015
