Job Order workers not receiving 20% premium and gratuity pay? What can they do?

Q: Good day po. Pwede po magtanong? Isa po akong JO sa isang NGA, been working there po for one and a half year na but ever since po wala pa po kaming natatanggap na premium of our salary or wage pati po yung 3k na gratuity pay. Ano po kaya ang action na pwede gawin for this po?

You might want to ask your superior about it first, if they cannot answer, then refer the matter to the HR as it is within their concern. If not, elevate to the head of office. Check also the guidelines because you may be entitled to:

(a) Premium – If your contract has a provision that you MAY be paid UP TO 20% premium PROVIDED the agency HAS AVAILABLE AND APPROVED budget for the said premium;

(b) Gratuity Pay – If the agency has AVAILABLE budget they can charge such benefit.
