Who should be the members of Disposal Committee?

Ano po ba talaga ang composition ng Disposal Committee? Sino pwede Chairman and Members? Hehe. Thank you very much.

Response:

Pursuant to EO 309 dated March 8, 1996, which you can download a copy here, amending EO 285 dated July 25, 1987, each Department bureau, office or agency are hereby reconstituted as follows:

Chairman — A senior official with a rank not lower than the level of an Assistant Secretary for a department and Assistant Director for a bureau/agency or department manager for a GOCC.

Member — Head of the Department’s administrative service or head of agency’s administrative division or head of the GOCC’s equivalent organizational unit.

Member — Head of the property unit.

In LGUs, the Local Government Code of 1991 provides the following provision:

ARTICLE 435. Committee on Awards. —

(a) There shall be in every province, city, or municipality a committee on awards which shall exercise exclusive jurisdiction in deciding the winning bids and questions of awards on procurement and disposal of supplies or property except in cases of procurement through emergency purchase, or when the amortization is specifically vested by law in another body. (b) The committee on awards shall be composed of the local chief executive as chairman; the local treasurer, the local accountant, the local budget officer, the provincial general services officer, the city general services officer, and the head of office or department for whose use the supplies are being procured, as members. In case a head of office or department would sit in a dual capacity, a member of the sanggunian elected from among its members shall sit as a member. (c) The committee on awards of the barangay shall be the sangguniang barangay.

(d) In no case shall a National Government official sit as a member of the committee on awards.
