Sender: Good day po, question lang po sa my mga Contract of service (CoS) employees, meron po kasi kami CoS earning more than P250,000.00 na nag opt for 8% tax rate.
Pinakiusapan ko yung BIR na this July na lang magstart yung withholding kasi less than P250,000.00 naman siya first half ng year and di sure kung marenew siya second half.
Tanong ko lang po, 5% po ba talaga ang withholding tsaka “professional” ang treatment sa kanya (wala po siya PRC)?
Nasa RMS 51-2018 po kasi taxpayer type daw is professional agad if >250k. Then, ano po yung ATC niya for 2307? (Wi010?)
Also, yung withholding po ba is payment x 5% OR excess ng 250k x 5% (as in walang withholding hanggang di pa abot P250,000.00 yung nareceive nya in a year)?

Mahirap mag compute kapag walang sinasubmit ng sworn declaration ang professional (kahit walang PRC) Also, REgistered by siya sa BIR? Ask for his Certificate of Registration. Need nila mag file quarterly taxes sa BIR and they should issue a receipt when they receiive payment. Sabi ng isang speaker (from BIR) treat them as a business, becoz they are in a business of selling services.
1. Kailangan magpasa muna sya ng Sworn Declaration either Lone Income Payor or Several Income Payor.
2. If Lone income payor, 5% in excess of 250k. If several payor, 5% on gross.
3. If Lone Income Payor, idivide mo yung 250k per month, nasa 20,833.33 yan. Yung in excess nyan time 5%, yung ang withholding mo per month.
4. If di sya nag pasa ng Sworn Declaration. 11% ang withholding on gross. 10% expanded income tax, 1% OPT
5. Yes WI010 kapag 5% ang ATC, WI011 kapag yung 10%.
