You should’ve decided if the items/supplies are overpriced at the time of deliberation pa ng BAC. Declaring an item as overpriced at the time of delivery is moot and academic kasi yung Purchase order at this point is already enforced so contract na yun and obliged na kayo as the procuring agency to pay the amount owed to the supplier/vendor. Otherwise, they have every right to file a case against you for not holding up your end of the bargain, which is to pay.
if the accountant is certain that the items are overpriced, you can sign a waiver so that in case it will be disallowed in audit due to overpricing; you will not be included as the persons liable.
If you are to read GPPB Opinion on the matter of overpricing.. the only instance that we can claim an item to be OVERPRICED hence we may opt to contest payment is kung monopolized ng seller yung market. meaning wala po syang kalaban at walang ibang provider tpos ang mahal ng benta nya. AGAIN, PURCHASE ORDERS are CONTRACTs in and of itself, it is two-way, so dapat bayaran natin what is due to the supplier/vendor.
As long as wala pang na incur na expenses related to the transaction yung supplier pwede nman icancel yung purchase or pa adjust yung price. Otherwise, pay for the proportionate amount.
Its really hard to say the item is overpriced esp if the procurement is thru public bidding. Even if you know suppliers who offer lower priced items, you are not sure if they joined the bidding or not. Check also the specs which make the difference.
If overpricing is documented and proven, prepare your memo to the head of the agency seeking approval not to disburse and citing solid evidence of overpricing. After all, when a law suit is filed against the agency, it is the head who will bear responsibility. In this instance, our role as accountants is advisory, in case of a lawsuit, accountants become witnesses.
For LGUs, accountants do not sign the PO and treasurers sign the CAF.
overpricing is complicated.you cannot compare apples to oranges.it goes true with brands and specs, the date and place a recanvass was made.in case of overpricing,it is the responsibility of the BAC to determine the reasonableness of price under RA 9184.better yet, have your concern be written to management for them to be aware of your concern parq hindi ka maisama sa primary accountable officers pag nagkaroon ng kaso ng overpricing
